General terms and conditions of rental and website use
Version in force as of [DATE À COMPLÉTER]
These terms and conditions apply to any booking of the accommodation “Chez Archibald” made on this website, as well as to use of the website itself. To book, you must accept them by ticking the designated box before payment. We recommend that you read them carefully and retain a copy.
Part 1 — General rental terms and conditions
1. Who is renting out the accommodation, and what is being rented
The landlady. The accommodation is rented out by its owner, a private individual who lives in the house of which the accommodation forms part. She may be represented for booking management purposes by a member of her family. A local concierge service handles guest arrivals and cleaning. In these terms and conditions, “we” means the landlady and, where applicable, her representative.
The accommodation. “Chez Archibald” is furnished tourist accommodation located in the centre of Sauzon, 56360 Sauzon (Belle-Île-en-Mer, Morbihan). The exact address is provided after booking.
- Registration number: [N° À VENIR]
- Classification: unclassified furnished tourist accommodation. (If subsequently classified, state here: “classified [X] star(s) by [organisme], on [date]”.)
It is a 2-room duplex forming part of a family home, for a maximum of 4 people:
- on the ground floor, a living area with an equipped kitchen and sofa bed;
- upstairs, a bedroom with a double bed;
- a shower room, a toilet;
- a washing machine, a drying rack, an ironing board and an iron.
The accommodation has no private outdoor space. The window overlooks a pedestrian street where, in fine weather, a table and two chairs may be placed outside, provided the passage is kept clear.
Cats live in the house: people with allergies must take this into account before booking.
The detailed description, photographs and inventory appear on the website and in the rental agreement.
2. Nature of the rental
This is a seasonal rental of furnished tourist accommodation, granted for a holiday or short stay. It is not a residential tenancy: the accommodation may not become the tenant’s main residence or be used to establish their domicile.
A rental may not exceed 28 consecutive nights. A minimum stay (2, 3 or 7 nights depending on the period) applies: it is indicated when booking.
3. How booking works
- You select your dates and the number of guests.
- The website displays a summary: dates, number of nights, nightly accommodation charges, cleaning fee, tourist tax, deposit amount and payment schedule.
- You check this summary, which you may correct, then tick the box accepting these terms and conditions and the rental agreement.
- We confirm availability and send you a link to pay the deposit.
- You receive confirmation by email and the rental agreement in PDF format, pre-filled with the details of your stay.
The booking becomes firm upon receipt of the deposit. The agreement is concluded online: ticking the box constitutes acceptance, without a handwritten signature.
The tenant must be an adult. They book for themselves and for the people accompanying them, for whom they undertake responsibility.
4. No right of withdrawal
In accordance with article L.221-28, 12° of the French Consumer Code, there is no right of withdrawal for accommodation services provided on a specified date or for a specified period. Once the booking is confirmed, only the cancellation terms in article 7 apply.
5. Price
The price is that displayed at the time of booking, in euros. It includes:
- the nightly accommodation charges, the rate for which varies according to the period;
- a cleaning fee of 70 € per stay, on a separate line;
- the tourist tax, on a separate line (see article 6).
Utilities (water, electricity, heating) are included [À VALIDER]. Bed linen and towels are provided.
In accordance with article L.324-2 of the French Tourism Code, the price and description of the premises appear in the written agreement provided to the tenant.
6. Tourist tax
The tourist tax is collected on behalf of the Communauté de communes de Belle-Île-en-Mer and remitted to it. It is payable by each adult for each night.
For unclassified furnished accommodation, it is equal to 5 % of the tax-exclusive nightly accommodation cost per person, capped at 4,90 € per person per night. Minors (under 18 years of age) are exempt. This rate may change in accordance with decisions of the local authority; the exact amount appears on a separate line when booking and in the agreement.
7. Payment, forfeitable withdrawal deposit (arrhes) and cancellation
The terms below are configurable. [À VALIDER : pourcentages, délais et montants]
7.1 Payment. Payment is made online on the website through [PRESTATAIRE DE PAIEMENT À COMPLÉTER]. We never have access to your full bank details.
- At booking: a forfeitable withdrawal deposit (arrhes) of 25 % of the rental price (nightly accommodation charges and cleaning fee, excluding tourist tax). [À VALIDER]
- The balance (remaining price and tourist tax) is payable 7 days before arrival.
- For a booking made less than 7 days before arrival, the full amount is paid at booking.
If the balance is not paid by the due date, and after a reminder has remained unanswered for [délai À VALIDER], the booking may be treated as cancelled by the tenant, with the consequences set out below.
7.2 Forfeitable withdrawal deposit (arrhes): what this means. The sums paid at booking constitute a forfeitable withdrawal deposit (arrhes) (this is also the default rule laid down by article L.214-1 of the French Consumer Code). Either party may therefore withdraw from the rental:
- a tenant who withdraws forfeits the withdrawal deposit (arrhes);
- a landlady who withdraws refunds twice the withdrawal deposit (arrhes).
7.3 Cancellation by the tenant. Cancellation must be made in writing (email to [E-MAIL À COMPLÉTER]); the date of receipt is decisive.
- More than 21 days before arrival: the tenant forfeits the withdrawal deposit (arrhes). Any other sums already paid are refunded.
- 21 days or less before arrival: the sums paid become a binding advance payment (acompte) and are no longer a forfeitable withdrawal deposit (arrhes). The full rental price remains payable. If we manage to relet all or some of the dates, we refund the nights relet.
- In all cases, the tourist tax for nights not stayed is refunded, as is the cleaning fee if the stay did not take place.
7.4 Late arrival, shortened stay. A stay that begins late or is shortened due to the tenant does not give rise to any refund, except for the tourist tax for nights not stayed. If the tenant has not been heard from 24 hours after the scheduled arrival date, the accommodation may be offered for rental again, and article 7.3 applies.
7.5 Cancellation by the landlady. If the landlady cancels the rental (other than due to force majeure), she refunds all sums paid to the tenant and additionally pays an amount equal to the withdrawal deposit (arrhes): the withdrawal deposit (arrhes) is therefore returned at twice its amount.
7.6 Force majeure. If an event of force majeure (within the meaning of article 1218 of the French Civil Code: an external, unforeseeable and irresistible event) prevents the stay for either party, the sums paid are refunded, less non-recoverable payment fees [À VALIDER]. No other compensation is payable.
8. Security deposit
Configurable. [À VALIDER]
A security deposit of 20 % of the rental price is required; it is not collected. Method of provision: [À COMPLÉTER — par exemple pré-autorisation bancaire via le prestataire de paiement].
It is returned no later than 2 months after departure, less any substantiated amounts for damage, missing items or exceptional cleaning. Any deduction is substantiated by the departure condition report and by invoices, quotations or photographs. If the deposit is insufficient, the tenant remains liable for the shortfall.
9. Arrival, departure and condition reports
- Arrival: from 13 h (17 h in high season).
- Departure: no later than 14 h (10 h in high season).
Arrival and key handover arrangements are communicated before arrival. A condition report and an inventory are prepared on arrival and departure, possibly by the concierge service. The tenant must report any discrepancy within 24 hours of arrival; otherwise, the accommodation is deemed to conform to the inventory. If the tenant is absent during the departure inspection, the report prepared by the concierge service is authoritative.
The accommodation must be left tidy, with dishes washed and bins emptied. The cleaning fee covers end-of-stay cleaning, not tidying up accommodation left in a poor state.
10. Use of the accommodation
Capacity. The accommodation may not accommodate more than 4 people, including children and babies. Above this number, excess guests may be refused access, without a refund. Any person not declared at booking must be notified before arrival.
Quiet and neighbours. The landlady lives in the house: the accommodation adjoins her own home. The tenant and those accompanying them undertake to occupy the premises peacefully, to keep noise down, particularly between 22 h and 8 h [À VALIDER], and not to disturb neighbours on the street.
Parties and events. Parties, evening gatherings and gatherings are prohibited.
Smoking. The accommodation is non-smoking (including electronic cigarettes). Smoking outside is permitted, provided no cigarette ends are left behind.
Pets. [À DÉFINIR]
Care of the accommodation. The tenant must use the accommodation and equipment carefully and for their intended purposes. They must not sublet the accommodation or transfer its use, even free of charge. They must promptly report any problem or breakdown. They must allow access to the accommodation for urgent repairs, following prior notification except in an emergency.
Pedestrian street. Any table and chairs placed outside in the street must be brought inside in the evening, and the passage must remain clear.
11. Liability and insurance
The tenant is liable for damage and losses caused during their stay by themselves or by those accompanying them. We strongly recommend that they hold holiday rental insurance or civil liability insurance covering seasonal rentals (often included in home insurance: check with their insurer).
The landlady is not liable for personal belongings left in the accommodation or for external inconveniences beyond her control (public works, network outages, transport conditions to the island, weather).
12. Individual police registration form
The law requires every guest of foreign nationality to complete an individual police registration form upon arrival (articles R.814-1 and following of the French Code on the Entry and Residence of Foreign Nationals and the Right of Asylum). It records: surname and given names, date and place of birth, nationality, usual home address, mobile telephone number, email address, arrival date and planned departure date. Children under 15 years of age may be included on the form of the adult accompanying them. These forms are retained for 6 months and disclosed only to the police or gendarmerie, at their request.

These terms and conditions and the rental agreement are governed by French law. In the event of a disagreement, the parties first seek an amicable solution. Failing this, the dispute is brought before the court having jurisdiction under the ordinary rules of law.
